Welcome to our Terms and Conditions of Use for Frances.O and Frances.co.uk. We ask that you please take time to carefully read these before placing an order with us. By using this website and / or placing an order you agree to be bound by the terms and conditions set out herein.

We also kindly draw attention to our Privacy Policy regarding use of personal information.

We uphold our right to alter our terms and conditions from time to time without notice.

ORDERS

As stated above, your purchase of any of our products offered on this site is subject to these Terms and Conditions and by placing an order for any product, you confirm that you have read these Terms and Conditions and agree to be bound by them.

Frances.O reserves the right to refuse an order for whatever reason, and also reserve the right to cancel an order that has already been placed with us (amongst others) in the following circumstances:

The product is unavailable / in stock (any payments shall be returned to the customer).
Your billing information is incorrect.
Your order is suspected of being fraudulent.
Your bank transfer is not received within 10 working days of the order being placed.
We have reason to believe that you are a a reseller
We are unable to deliver to the address that you have provided to us.

ORDER CONFIRMATION

After submitting your order, we will send you an order confirmation e-mail acknowledging your order. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy the product(s) ordered. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking the purchase button, you enter into an obligation to pay for the Product(s).

ACCEPTANCE

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order and these Terms and Conditions. The contract between you and us in relation to the product(s) ordered (“Contract”) will only be formed when we send you the shipping confirmation email. After entering into the Contract, we will be under a duty to supply you with goods that are in conformity with the Contract. Please note that the Contract will only relate to the product(s) which have been confirmed in the shipping confirmation email. We will not be obliged to supply any other Product(s) which may have been part of your order until such product(s) have been confirmed in a separate shipping confirmation email. Please note that all products presented on the website are made to order.

PROCESSING AND SHIPPING

Every piece is made to order so please allow a minimum one (1) week for between order placement and delivery.

To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit / debit card or PayPal account when placing an order.

Items are shipped Delivery Duties Unpaid (DDU), therefore any customs or import duties are charged once the parcel reaches its destination country. Unfortunately we have no control over these charges. Please therefore be aware of the applicable customs policies and import duties which may affect you, prior to placing an order.

PAYMENT

Payments may be made via PayPal.

All purchases shall be subject to relevant validation checks and authorisation by the card issuer. If the issuer of your card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

PRICES

The prices and delivery costs shown on the website include VAT. The prices and delivery costs shown on the website may vary from time to time and Frances.O is not bound by the price until Frances.O has accepted the order by sending the shipping confirmation to you. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. Fracnes.O always reserves the right to cancel any order prior to our acceptance of the order. If we have already received payment for a cancelled order we will refund you the amount of the purchase. The refund is made using the same payment method you used at the purchase. Please also note that Frances.O may cancel the order even if it has been accepted by Frances.O under the condition that you realise or should have realised that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

RETURNS

Unfortunately, due to the personalised nature of the made-to-order items created by Frances.O, we do not accept returns, refunds or exchanges of unwanted items which have been purchased and received by the customer. Similarly, the customer does not have the right to cancel an order. Please therefore carefully check measurements before purchasing,

RISK AND OWNERSHIP

Items shall be at your own risk and under your ownership from time of delivery.

PRODUCT INFORMATION / CARE OF INSTRUCTIONS

Whist we wish you to wear these designs anywhere and everywhere, they are not salt water friendly, and therefore we strongly advise against wearing them in the sea as this may erode the product.

As our items are handmade and are typically made to fit a range of sizes, all measurements and descriptions are approximate, however we do make every effort to ensure they are as accurate as possible,

INTELLECTUAL PROPERTY

All Intellectual Property, including designs, photos, and ideas belong solely to Frances.O. Any infringements shall be pursued by all legal means available to us.

All rights, including copyright, in this website are owned by or licensed by Frances.O. Any uses of this site or its contents, including copying or storing it or them in whole or in part, other than for your own personal, non-commercial use is prohibited without the permission of Frances.O

LIABILITY

Nothing in these Terms and Conditions shall limit or exclude our liability to you:

for death or personal injury caused by our negligence;
for fraudulent misrepresentation;
for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded;
under Part I of the Consumer Protection Act 1987; or
for any other liability that, by law, may not be limited or excluded

Subject to this, if you are a consumer and not a business customer, in no event shall we be liable to you for any business losses, and if you are a business customer, in no event shall we be liable to you for any indirect or consequential losses, or for any loss of profit, revenue, contracts, data, goodwill or other similar losses, and any liability we do have for losses you suffer arising from any Contract shall not exceed the purchase price of the relevant Product(s) and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. Subject to the above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any Contract that is caused by events outside our reasonable control, including war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events.

SEVERABILITY

If any part of these Terms and Conditions herein are held to be invalid or unenforceable, such decision shall not invalidate any other remaining provision of these Terms and Conditions. The invalid terms and conditions shall be replaced with compliant terms in order to give effect to the original commercial intentions of these Terms and Conditions.

LEGAL JURISDICTION

These terms and conditions shall be governed by and construed in accordance with English Law, and it is agreed that the English courts shall have ultimate and exclusive jurisdiction in the event of a dispute.

LANGUAGE

The language of the Terms and Conditions is English.
